Abstract

               งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาเขตอำนาจศาลในคดีผู้บริโภคในระบบกฎหมายไทยที่เป็นอยู่ในปัจจุบันว่าสามารถอำนวยความสะดวกแก่ฝ่ายผู้บริโภคในการฟ้องคดีหรือต่อสู้คดีได้อย่างเพียงพอตามเจตนารมณ์ของกฎหมายคุ้มครองผู้บริโภคหรือไม่


               จากการศึกษาพบว่า กรณีผู้บริโภคหรือผู้มีอำนาจฟ้องคดีแทนผู้บริโภคเป็นโจทก์ฟ้องผู้ประกอบธุรกิจนั้นเป็นกรณีที่ต้องใช้บทบัญญัติตามประมวลกฎหมายวิธีพิจารณาความแพ่งซึ่งกำหนดให้ผู้บริโภคในฐานะโจทก์สามารถเลือกฟ้องคดีต่อศาลซึ่งผู้ประกอบธุรกิจในฐานะจำเลยมีภูมิลำเนาอยู่ในเขตศาลหรือ ศาลที่มูลคดีเกิดขึ้นในเขตศาล ผลจากการตีความภูมิลำเนาและมูลคดีทั้งมูลสัญญาและมูลละเมิดอย่างกว้างขวางในกฎหมายไทย ทำให้ฝ่ายผู้บริโภคสามารถเลือกฟ้องคดีต่อศาลได้ในหลายท้องที่ อย่างไรก็ตาม เพื่อให้การคุ้มครองผู้บริโภคในกรณีนี้มีประสิทธิภาพมากยิ่งขึ้น ผู้วิจัยมีข้อเสนอแนะว่า พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 ควรบัญญัติเขตอำนาจศาลให้ฝ่ายผู้บริโภคสามารถฟ้องผู้ประกอบธุรกิจต่อศาลที่ผู้บริโภคมีภูมิลำเนาหรือถิ่นที่อยู่อยู่ในเขตศาลในขณะที่เข้าทำสัญญากับผู้ประกอบธุรกิจหรือได้รับความเสียหายจากสินค้าที่ไม่ปลอดภัยได้ด้วย    


               ในกรณีที่ฝ่ายผู้ประกอบธุรกิจเป็นโจทก์ฟ้องผู้บริโภคเป็นจำเลยนั้น การที่มาตรา 17 พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภคได้จำกัดสิทธิผู้ประกอบธุรกิจในการเสนอคำฟ้องต่อศาลที่ผู้บริโภคมีภูมิลำเนาอยู่ในเขตศาลได้เพียงแห่งเดียวนั้นส่งผลให้ผู้บริโภคที่มิได้อาศัยอยู่ ณ ภูมิลำเนาของตนเองไม่ได้รับการอำนวยความสะดวกตามเจตนารมณ์ของกฎหมาย และยังไม่อาจใช้วิธีการโอนคดีตามมาตรา 6 ประมวลกฎหมายวิธีพิจารณาความแพ่งได้ ส่วนการใช้ภูมิลำเนาเฉพาะการนั้นก็มีผลเพียงเอื้อประโยชน์ให้กับฝ่ายผู้ประกอบธุรกิจเท่านั้น งานวิจัยมีข้อเสนอแนะว่าพระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 ควรบัญญัติรับรองสิทธิของผู้บริโภคในฐานะจำเลยที่จะยื่นคำร้องขอโอนคดีไปยังศาลอื่นๆ ได้ด้วยอย่างชัดแจ้ง ได้แก่  ศาลที่มูลคดีเกิดขึ้นในกรณีคำฟ้องทั่วไป หรือศาลที่อสังหาริมทรัพย์ตั้งอยู่ในเขตศาลในกรณีคำฟ้องที่เกี่ยวด้วยอสังหาริมทรัพย์


 


               The objective of this research is to investigate current problems concerning the territorial jurisdiction of consumer cases in Thai legal system and whether it is able to provide adequate assistance, for consumers to proceed or defend a lawsuit, in compliance with the purpose of consumer protection laws. 


               The research found that, in the case where the consumer or person having the power to file a lawsuit on the consumer’s behalf is the plaintiff against the business operator, in compliance with the civil procedure code of Thailand, the consumer, as the plaintiff, is entitled to file a case in court within the territorial jurisdiction of which the defendant is domiciled or the place where the cause of action occurred. Due to extensive legal interpretation of the cause of action and the term “domicile” in contract cases and tort cases in Thai legal system, the consumer is entitled accordingly to file a lawsuit in various territorial jurisdictions. Nevertheless, the research found that, in consideration of better and more efficient consumer protection, the consumer case procedure act, B.E. 2551 should allow the consumers to file a lawsuit in territorial jurisdiction of their domicile or residence in the time they entered into the contract with the business operator or where the damages arisen from unsafe goods.


               In the case where the business operator is the plaintiff against the consumer, the section 17 of the consumer case procedure act stipulates that the business operator is entitled to submit a case only to the court within the territorial jurisdiction of which the consumer is domiciled. The consumer, who does not reside in their legal domicile, would thus suffer inconveniences, which is the opposition of the consumer protection law’s purpose. Furthermore, the change of venue process, according to section 6 of Thai civil procedure code, cannot be proceeded. Special domicile, which allows the parties to determine other residence than the legal domicile, would only benefits business operators. This research suggests that the consumer case procedure act should explicitly allow the consumer, as the defendant, to request for the change of venue, the process that transfers the case to other court, including the court where the cause of action occurred in general plaint or the court within the territorial jurisdiction of which the disputed immovable property is located in the plaint concerning immovable property.
