แนวทางการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) ขององค์การบริหารส่วนตำบลในเขตอำเภอเมือง จังหวัดเพชรบุรี (Corruption in Procurement and Employment with Act B.E. 2017 (New Issue) of Subdistrict Administration Organization in Muang District, Phetchaburi Province)

Abstract

              การวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาผลของการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) 2) ศึกษาปัจจัยที่มีอิทธิพลต่อการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) และ 3) สังเคราะห์หาแนวทางการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) ที่เหมาะสมกับองค์การบริหารส่วนตำบลในเขตอำเภอเมือง จังหวัดเพชรบุรี ดำเนินการศึกษาเชิงปริมาณ โดยใช้แบบสอบถามจากกลุ่มตัวอย่างคือสมาชิกองค์การบริหารส่วนตำบลในเขตอำเภอเมือง จังหวัดเพชรบุรี จำนวน 192 คน และดำเนินการศึกษาเชิงคุณภาพ โดยใช้แบบสัมภาษณ์แบบมีโครงสร้างจากผู้ให้ข้อมูลสำคัญคือ นายกองค์การบริหารส่วนตำบลในเขตอำเภอเมือง จังหวัดเพชรบุรี จำนวน 5 คน ที่เลือกแบบเจาะจง มาเป็นตัวแทนผู้ให้ข้อมูล สถิติที่ใช้ในการวิเคราะห์ข้อมูลคือ ค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และการวิเคราะห์การถดถอยพหุคูณแบบขั้นตอน

               ผลการวิจัยพบว่า 1) ผลของการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) โดยรวมและรายด้านมีการปฏิบัติอยู่ในระดับมาก เรียงตามลำดับดังนี้ ด้านการมีประสิทธิภาพและประสิทธิผล ด้านความคุ้มค่า ด้านความโปร่งใส และด้านการตรวจสอบได้ ตามลำดับ 2) ปัจจัยที่มีอิทธิพลต่อการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) ได้แก่ หน่วยงานของรัฐคำนึงถึงคุณภาพ เทคนิค และวัตถุประสงค์ของการจัดซื้อจัดจ้าง (X₃) เจ้าหน้าที่รัฐ ผู้ที่มีหน้าที่ดำเนินการต้องไม่เป็นผู้มีส่วนได้เสียกับผู้อื่นเสนอราคา (X₄) หน่วยงานของรัฐจัดให้มีการบันทึกรายงานผลการพิจารณารายละเอียดวิธีการและขั้นตอนการจัดซื้อจัดจ้างและจัดเก็บไว้อย่างเป็นระบบ (X₂) และหน่วยงานของรัฐจัดทำแผนการจัดซื้อจัดจ้างประจำปีและประกาศเผยแพร่ในระบบเครือข่ายสารสนเทศ (X₁)   และ 3) แนวทางการป้องกันการทุจริตในการจัดซื้อจัดจ้างตามพระราชบัญญัติ พ.ศ.2560 (ฉบับใหม่) คือ องค์การบริหารส่วนตำบลในเขตอำเภอเมือง จังหวัดเพชรบุรี ควรจัดทำแผนจัดซื้อจัดจ้างและควบคุมการดำเนินงานให้เป็นไปตามแผนที่กำหนด เพื่อให้การดำเนินงานในแต่ละขั้นตอนตลอดจนระยะเวลาให้เป็นไปตามระเบียบ จัดเตรียมช่องทางการประชาสัมพันธ์ที่หลากหลาย และเพิ่มวิธีการจัดหาพัสดุด้วยวิธีประกวดราคาอิเล็กทรอนิกส์ เพื่อลดปัญหาในกระบวนการจัดซื้อจัดจ้างและให้มีมาตรฐานเดียวกัน

               The purpose were to study: 1) study the result of preventing corruption in procurement according to the new Act, 2) investigate the factors influencing prevention of corruption in procurement according to the new Act, and 3) synthesize to find the guidelines, proper to Subdistrict Administrative Organizations (SAOs) in Mueang District, Phetchaburi Province, for preventing corruption in procurement according to the new Act. For quantitative study, the questionnaire was used for collecting data from the samples, 192 members of SAO Councils in Mueang District, Phetchaburi Province. For qualitative study, the structured interview form was used for collecting data from 5 key informants purposively selected from Chief Executives of SAOs in Mueang District, Phetchaburi Province. The data were analyzed by using percentage, mean, standard deviation, and stepwise multiple regression analysis.

               The research results were as follows: 1) The result of preventing corruption in procurement according to the new Act was overall at a high level. The 4 aspects of the result could be ranked in descending order of their means as follows: efficiency and effectiveness, cost-effectiveness, transparency, and accountability, 2) The factors influencing prevention of corruption in procurement according to the new Act were public organizations regarding quality, technique, and objectives of procurement  (X₃), government officials not to be bidders’ stakeholders (X₄), public organizations having decision results, including procurement detail, approaches, and procedure, recorded and systematically kept (X₂), and public organizations preparing annual procurement plan and disseminating it in information network system (X₁), and 3) The guidelines for preventing corruption in procurement according to the new Act were that SAOs in Mueang District, Phetchaburi Province, should prepare the procurement plan and strictly control the plan implementation to keep the procedure and time period performed according to the regulations, that various channels for public relation should be prepared, and that approaches for procuring supplies by e-auction should be increased, to reduce the problems in procurement process and to keep the same standard.
