บทคัดย่อ
บทความฉบับนี้มุ่งอธิบายถึงความเป็นสูงสุดของธรรมนูญฟีฟ่าซึ่งกฎหรือระเบียบข้อบังคับในวงการกีฬาฟุตบอลใดจะขัดหรือแย้งต่อธรรมนูญดังกล่าวมิได้ บทความฉบับนี้ยังมุ่งวิเคราะห์ความเป็นสูงสุดของธรรมนูญฟีฟ่าผ่านมุมมองของความเป็นอิสระในการปกครองและกำกับกีฬาฟุตบอลสากลของฟีฟ่า อีกทั้งยังให้ข้อโต้แย้งในทำนองที่ว่าการบังคับใช้ธรรมนูญฟีฟ่าเช่นว่านี้จะบังคับใช้กับสมาชิกของฟีฟ่าเท่านั้น หากไม่ใช้สมาชิกของฟีฟ่าก็ไม่จำต้องปฏิบัติตามธรรมนูญของฟีฟ่าและกฎระเบียบต่าง ๆ ที่เกี่ยวข้อง ฟีฟ่าได้บังคับใช้บทบัญญัติหรือระเบียบข้อบังคับของสหพันธ์ ด้วยการให้กลุ่มสมาชิกที่เกิดขึ้นมาจากการรวมตัวระหว่างสมาชิกด้วยกันหรือสมาคมกีฬาฟุตบอลในแต่ละสมาคมที่อยู่ภายใต้สังกัดของฟีฟ่า ดำเนินกลไกว่าด้วยการบังคับใช้วิธีการควบคุมหรือการลงโทษทางวินัยในลักษณะที่อยู่ภายใต้การควบคุมในสายการบริหารตามลำดับชั้นและบังคับใช้ข้อกำหนดที่มุ่งขจัดการกระทำที่ไม่ซื่อสัตย์สุจริตหรือพฤติกรรมไม่ถูกต้องชอบธรรมอันเนื่องมาจากสมาชิกของฟีฟ่า เหตุนี้เองฟีฟ่าในฐานะที่เป็นองค์กรสูงสุดในการปกครองกีฬาฟุตบอลสากลซึ่งมีอำนาจในการออกบทบัญญัติหรือระเบียบข้อบังคับขึ้นมาปกครองกีฬาฟุตบอลสากลภายใต้การดำเนินงานกำกับตนเองอย่างเป็นอิสระ แล้วบทบัญญัติหรือระเบียบข้อบังคับเช่นว่านี้ก็ถูกใช้เป็นเครื่องมือขององค์กรปกครองกีฬาฟุตบอลสากลของฟีฟ่าในทำนองที่ให้บรรลุวัตถุประสงค์ในการควบคุมหรือกำกับกีฬาฟุตบอลสากล อีกทั้งฟีฟ่าในฐานะที่เป็นองค์กรสูงสุดในการปกครองกีฬาฟุตบอลสากลยังได้บัญญัติธรรมนูญฟีฟ่าขึ้นมาเพื่อให้อำนาจออกกฎระเบียบหรือออกคำสั่งลงโทษทางวินัยแก่สมาชิกของตนที่กระทำการอย่างหนึ่งอย่างใดในลักษณะที่ไม่ซื่อสัตย์สุจริตหรือในทำนองที่ไม่ถูกต้องชอบธรรม
