Instructions For Taking Still or Movie Photos in Accordance with The Personal Data Protection Act (PDPA)

Abstract

This article reviewed information from a variety of sources, including scholarly articles, electronic documents, and reputable websites. It aims to provide guidelines for correctly requesting permission to take still or moving images of people, including the use and distribution of still or moving images on social media platforms in accordance with the Personal Data Protection Act (PDPA) B.E.2562 (2019). Capturing still or moving images of individuals is considered to fall within the scope of protection under the Personal Data Protection Act (PDPA) as it involves photographs displaying identifiable faces. The act of capturing images poses a risk of violating individuals' rights and the law, potentially resulting in lawsuits. Whether taking still or moving images in private locations, shops, workplaces, government offices, or hospitals, workers must work with caution and be mindful of the privacy rights of others. The author has divided the recommendations into two parts: Part 1: Correctly requesting permission to take still or moving images of people; Part 2: Recommendations for taking still or moving images in accordance with the Personal Data Protection Act (PDPA). Although this article focuses on still or moving images in hospitals, those who are interested can apply it to other forms of still or moving images and in various locations. This guideline aims to prevent violations of the rights and freedoms of others, which could harm the reputation and image of the personal data owner and seriously impact their family. It also encourages workers to act in accordance with the law, reducing the risk of legal violations.
